摘要
为落实以审判为中心的诉讼制度改革,检察机关全面落实员额制。其要求凡入额检察官需通过遴选任命,参与一线办案并对案件终身负责。员额制有助于遴选能者办案,有助于提高检察人员专业化水平,有助于全面落实责任制,防止冤假错案。但员额制不能是终身制,应当建立和完善退出机制,明确退出情形,增加权利救济内容,拓宽遴选委员会职能,让检察人员在工作中寻求归属感、荣誉感、成就感。
In order to implement the reform of the litigation system centralized on the trial,the procuratorial organ begins to carry out the post system.It is demanded that the post prosecutors must be selected and appointed.In addition,the post prosecutors must deal with the cases and should be responsible for these cases for life.The post system contributes to selecting the procurators of ability,enhancing the professional level of the post prosecutors and implementing judicial responsibility system fully,and preventing wrongful conviction cases.However,the post system should not be tenured,and the withdrawal mechanism ought to be established and completed,the situations and procedures of withdrawal defined,the content of right relief increased,and the functions of the search committee expanded so as to make the procurators seek the sense of belonging,the sense of honor and the sense of achievement.
