摘要
“保证党中央令行禁止,保障宪法法律实施,保护公民法人合法权利”在2018年备案审查年度报告中被描述为“备案审查工作的初衷所在、职责所在”。关于备案审查制度基本功能的认识与表述,以历年全国人大常委会工作报告以及两份备案审查工作报告为主要线索进行文件文献梳理,并参照合宪性审查基本功能演变的比较法轨迹,可以发现,内涵完整、动态发展的基本功能逻辑结构呈现为:“维护国家法制统一”以“保证中央令行禁止”为重点并作为其主要实现途径,“保护公民合法权益”为备案审查之动力机制并适时确认其结构比重的不断提高。正在制定中的《全国人大常委会备案审查工作规定》需专设基本功能条款为此逻辑结构及其动态发展提供规范依据。
In the 2018 annual report on recording and reviewing normative documents,the purpose of the record and review system is described as"to ensure the authority of the Central Committee of the CPC,to make sure the implementation of the Constitution and law and to protect citizens’legal rights".In this research,focusing on the understanding and expression of the basic function of the record and review system,we carried out a textual analysis of the annual work reports of NPC Standing Committee and its two annual reports on recording and reviewing normative documents.By aligning our textual analysis with the data of the evolution of the basic function of constitutional review from a comparative law perspective,we can find that the complete logic of the evolution shows a dynamic structure as follows:"to ensure the supreme authority of the Central Committee of the CPC"is the focus of and major approach to "the unification of the state legal system";in the record and review system,"to protect citizens’legal rights"is its driving force and will play bigger part in due course.Rules on Recording and Reviewing Normative Documents of NPC Standing Committee,which is now under construction,should include specific provisions to guarantee the legitimacy of such logical structure and its dynamic development.
