摘要
从监督是检察机关的立身之本出发,首先对前两批包括上海、广东、福建、天津自贸区民商事纠纷解决的现状进行了分析,发现自贸区民商事纠纷因整体占比高、爆发速度快、涉及领域新而成为司法关注重点。随后对四自贸区内审判、仲裁、调解等渠道的探索实践进行了介绍,概括出现有纠纷解决的基本方案,并总结出相较于解决渠道、规范明确、司法服务的大力推进,自贸检察虽有监督职能,其监督力度却面临“空”“泛”“软”的困境。随后再从新时代“枫桥经验”探索的源头治理、多元治理、依法治理的实践角度分析了化解困境的可行性,最终借鉴经验总结出从源头出发监督调解,用多元方式监督仲裁,依法律规定监督审判是强化检察监督行之有效的具体路径。
Starting from the fact that supervision is the foundation of procuratorial organs,the research group first analyzes the current situation of civil and commercial disputes settlement in the first two groups,including Shanghai,Guangdong,Fujian and Tianjin free trade zones,and finds that civil and commercial disputes in the free trade zones have become the focus of judicial attention due to their high proportion,rapid outbreak and new fields involved.Then the group introduces the exploration and practice of trial,arbitration,mediation and other channels in the four free trade zones,summarizes the basic scheme of dispute resolution,and summarizes that compared with the promotion of resolution channels,clear norms and judicial services,although the free trade procuratorial has the function of supervision,its supervision is facing the dilemma of being empty,extensive and soft.Then the group analyzes the feasibility of solving the dilemma from the perspective of the practice of source governance,multiple governance and legal governance explored by Fengqiao Experience in the new era.Finally,it is concluded that the specific path to strengthen the procuratorial supervision is to supervise mediation from the source,to supervise arbitration in multiple ways,and to supervise trial in accordance with the law.
