摘要
国际软法是"一带一路"合作机制的重要组成部分,很好地应对了"一带一路"合作机制构建中的法律冲突,而国际软法渐进的生成模式也在一定程度上克服了当代国际法规则导向创制模式的弊端。与国际硬法相比,国际软法具有主体多元、表现形式多样、制定程序更为简易、更易取得实效等优点,这也是构建"一带一路"合作机制中重视国际软法的重要原因。国际软法的引领、补充和重构功能,可以更好地促进"一带一路"合作机制中硬法机制的形成。
International soft law is an important part of the Belt and Road cooperation mechanism.International soft law has coped well with the conflict of laws in the construction of the the Belt and Road cooperation mechanism,and the gradual formation mode of international soft law has overcome the drawbacks of the rule-oriented creation mode of contemporary international law.Compared with international hard law,international soft law has many advantages,such as pluralistic subjects,diverse forms of expression,simpler procedures and sometimes better legal effects.This is also an important reason for attaching importance to international soft law in the construction of the Belt and Road cooperation mechanism.With the help of the leading,supplementing and reconstructing functions of international soft law,we can better promote the formation of hard law mechanism in the Belt and Road cooperation mechanism.
