摘要
伴随着塑料工业的不断发展,塑料制品让人们的生活有了极大的便利,获得了不少的经济利益。同时,由于塑料垃圾的不合理处置,越来越多的塑料进入海洋,对海洋生态环境产生了极严重的污染,严重威胁海洋生物多样性。在此背景下,有必要立足于现今海洋塑料垃圾污染的紧迫形势,积极在国际法框架下治理海洋塑料垃圾。通过梳理当前有关海洋塑料废物管理的国际法规范和国内法规范,发现全球海洋塑料垃圾治理仍然存在执法标准不统一、问责机制不健全、污染源规制有限和国际条约强制力不足等问题,从国际法的执行机制、问责体系、规制范围和审核机制四个方面提出具体的改进建议。
With the continuous development of the plastic industry,plastic products have brought great convenience and economic benefits to our lives.At the same time,due to the unreasonable disposal of plastic garbage,more and more plastics enter the ocean,causing extremely serious pollution to the marine ecological environment,which has seriously threatened marine biodiversity.In this context,it is necessary to actively control marine plastic waste under the framework of international law based on the current urgent situation of marine plastic waste pollution.Through combing the current international and domestic laws and regulations on the management of marine plastic waste,four issues are found,including the inconsistencies in law enforcement standards in the global marine plastic waste management,the unsound accountability mechanism,the limited pollution source regulations,and the insufficient international treaties.The improvement suggestions are proposed from implementation mechanism,accountability system,scope of regulation and review mechanism of international law.
