摘要
我国实行的是城乡分割的二元土地制度,对农村土地转用实行了严格的限制,农村土地转用为城市土地必须经过政府征收。特殊的制度安排和大量出现的农村土地征收情况使得农村土地征收问题成为近些年学界研究的一个热点。梳理、比较相关文献给出的在土地儈理征收等制度存在问题和产生的原因,征地拆迁中的冲突、利益纷争,土地增值收益分配,农户的福利变化以及土地制度改革方面的研究状况。对未来研究方向进行展望,以期对后续相关研究发挥助推作用。
China implements a dual land system that divides urban and rural areas, in which strict restrictions are imposed on the conversion of rural land, and the conversion of rural land into urban land must be expropriated by the government. The special institutional arrangements and the large number of rural land expropriation have made the issue of rural land expropriation a hot spot in recent years. Through combing and comparing relevant literature, this paper summarizes the research status of relevant studies on rural land expropriation, including the existing problems and causes of the land management and expropriation system, the conflicts and interests disputes in land expropriation and demolition, the distribution of land value 一 added income, the welfare changes of farmers, and the reform of land system. Based on the analysis of the above - mentioned literature, it looks forward to the future research direction, in order to play a supporting role in the subsequent related research.
