摘要
实施乡村振兴战略是党的十九大作出的重要战略部署,中央农村工作会议提出乡村振兴的重点是完善产权制度和要素市场化配置。产权,是乡村振兴的新动能,是乡村振兴战略全面推进过程中最核心、最基础的制度性供给,"产权一明,‘三农’皆活;产权一清,发展畅通"。从目前试点中的改革目标来看,在承包权、资格权和股份权的基础构成要素中,依然同时兼有身份权和财产权的权能。财产权可以自由流通,身份权则不同。这种权能构成,既制约要素市场化配置的实现,又可能动摇集体所有制基础。如果将以上权能中的身份权属性划归所有权中,成立"农村所有权人集体",履行所有权权能,则可在一定程度上释放财产权的自由,在不突破相关法律法规的前提下,降低制度性交易成本,确保农村改革既不突破集体所有制的底线,又能实现要素市场化配置的目标。
The implementation of the rural revitalization strategy is an important strategic plan made by the 19th National People's Congress.The central rural work conference proposed that the key of rural revitalization is to improve the property rights system and the allocation of factor marketization.Property right is the new impetus for rural revitalization,it's also the most core and fundamental institutional supply in promoting the rural revitalization process in an all-round way.The property right is distinct agriculture,rural areas and farmers are living.The property right is clear,the development is unimpeded.From the point of the pilot reform of the target,contract right,the right of qualification and constituent elements of the basis of stock right,still has the power of the identity rights and property rights.The of property rights can be free flow,identity right is different.This kind of power can both restrict the realization of the element marketization disposition,and shake the foundation under collective ownership.If the identity right be attributedto power of ownership,establishingthe"rural collective ownership,"performance the ownership of power,can release free of property rightsto a certain extent,under the premise ofnot break through the relevant laws and regulations,we can reduce institutional trading costs,ensure that rural reform is neither break through the line of collective ownership,and achieve the goal of marketization configurationof elements.
