摘要
行政机关对市场活动的监管包括事前审批和事后监管两个阶段,行政"黑名单"已经成为事后监管措施中最有效的一种,在我国行政执法领域得到广泛运用。然而,我国法律体系中并没有对"黑名单"直接规定,使得行政活动于上位法无据。要在我国建立完整且合理的行政"黑名单"制度,应制定专门立法,统一设定入"黑名单"标准,引入"黑名单"复议或行政诉讼的救济程序,切实保障行政相对人的合法权益。
The administrative institution supervises the business activities mainly from two aspects:before-event examination and approval and after-event supervision.The practice of administration“blacklist”has become the most effective means of after-event supervision and hence is widely used in administration.However,there is no direct regulation to the“blacklist”.As a result it lacks legal support.It is suggested to have special legislation and make standards.It is also suggested to introduce the relief procedure for administrative reconsideration or administrative litigation to protect the object’s legal right.
