摘要
水资源是人类以及众多生物赖以生存的重要要素之一,也是促进生产、发展经济的重要经济资源。由于淡水资源数量总体上的匮乏,时空上的分布不均衡,以及人类不合理的开发利用方式,致使全球许多地方正面临着严重的水资源危机。公平合理利用原则作为国际水法中处理跨国水资源利用和保护的一项基本原则,对于淡水资源的分配、保持生态系统的环境质量和促进区域和平等各方面都起到了重要作用。但是其评价要素、配套机制和国际合作等制度的不完善制约了公平合理利用原则的效力,应对其进行必要地改造和完善,以保障国际淡水资源的和谐利用。
Water resource is one of the important elements of human beings and any other creatures,as an economic resource,it is also important to promote production and economic development.Many places of the world are facing an increasingly serious water crisis because of the lack in quantity、unbalanced distribution in time and space and the unreasonable utilization manners.The fair and reasonable utilization principle is the basic principle of international water law in using and protecting transboundary water resources,it is important in allocating freshwater resources、maintaining the environmentquality and keeping regional peace.There are some restrictions like evaluation factors、supporting mechanism and international cooperation,which are not perfect to the principle for now.In order to accelerate the harmonious using of the international water resources,the fair and reasonable utilization principle needs to being transformed and perfecting necessarily.
