摘要
除了政治和外交努力之外,运用国际法的手段来解决因国际河流的利用导致的冲突已成为各国的共识。文章试图梳理现有跨境共享水资源的国际规则,分析跨境共享水资源过程中的各种国家利益冲突,并为跨境共享水资源管理提出一个新的框架,以期通过国际法的手段预防和解决跨境共享水资源利用(主要集中在国际河流利用)引发的国际冲突。
Apart from political and diplomatic efforts, international law has been a more and more accepted common approach to such disputes. This paper endeavors to provide a general view of international laws pertinent to utilization of international river. The paper analyzes the interests at conflict in utilization of international river and offers a new structure of the management. The author hopes that the use of international law will be an effective mechanism both to prevent and solve international disputes and conflicts arising from utilization of international rivers.
