摘要
社会服务机构退出制度设计必须考虑社会服务机构的特殊性。由于社会服务机构属于第三部门,具有无所有权人、向社会提供公共物品等特征,在退出时存在剩余财产和未完结业务处理以及"僵尸"社会服务机构等问题。因此,在具体的制度设计中应当充分考虑在市场化处理失灵的情况下政府机构作用的发挥。社会服务机构退出制度应由全国人大立法予以规定,退出制度应包含破产法与非破产法在内的多层次机制,并应明确对社会服务机构业务和剩余财产接管的行政机关,构建对社会服务机构的分层监管机制。
The withdrawal system of social service institutions must take into account their particularity.When withdraw from the market,how to deal with the surplus property and the unfinished business of the social service institutions also remain a problem for they have some special characters such as they belong to the third sector,with no ownership,providing collective goods for public and creating“zombie”social service institutions.The withdrawal system of social service institutions should be ruled by the National People's Congress legislation and amultilevel system of the withdrawal of social service institutions which include bankruptcy mechanism and non-bankruptcy mechanism should be included.Besides,the government agencies that take over the surplus property and the unfinished business must be explicitly stipulated and constructing a hierarchical supervision mechanism for social service institutions.
