摘要
法治的一般性体现在人们对法治内涵的认知共识、法治的国际属性和评价标准的相对客观性上。法治的特殊性体现在法治的价值、理论、道路和制度等多个层面。作为价值的法治具有一般性和普世性,但作为价值载体的法律制度则不一定具有一般性。形式法治可以成为人类社会最低限度的法治共识。中国的法治发展需要积极借鉴法治普世规律,不过,用法治价值的普适性无法推导出法治模式和道路的普适性。虽然学理上接受的法治价值主要为自由主义,但中国法治实践的内在取向确是偏重于国家主义的。逻辑上,国家主义的法治模式与以限权为核心的法治追求存在着一定错差。未来中国的法治建设需要适度吸纳自由主义内涵,以更好地维护个人的权利、自由和尊严。
The generality of rule of law is embodied in the relative objectivity of people＇ s under- standing of the connotation of the rule of law, the international attributes of the rule of law and the evalu- ation criteria. The particularity of the rule of law is embodied in the values, theories, roads and institu- tions of the rule of law. The rule of law as a value is general and universal, but the legal system as a carrier of value does not necessarily have a general nature. A formality of rule of law can be the human society＇ s common ground on rule of law at the minimum. China＇ s rule of law needs to actively learn from the rule of law, but the universality of the model of and the road to the rule of law cannot be derived from the universality of the value of the rule of law. Although the academically accepted value of the rule of law is liberalism, the internal orientation of China＇ s rule of law practice emphasizes on nationalism. Logically, a nationalism model of rule of law differs from the pursuit of rule of law which focuses on limiting powers. In the future, the construction of the rule of law in China needs to absorb the connotation of liberalism in order to better protect the rights, freedoms and dignity of the individual, thereby realizing a reasonable balance between nationalism and liberalism in the value of the rule of law.
