摘要
集体经营性建设用地入市已经进入试点阶段,但集体经营性建设用地入市中集体与成员之间权利配置问题并未妥善解决。从集体所有权和集体成员权的视角考量集体与成员之间权利配置问题较为妥当,具体应遵循利益均衡原则、不违反国家管制前提下的私法自治原则以及社会效益最大化原则。在集体经营性建设用地入市的制度构造中,立法应保障集体的利益分配权和成员的决策权、撤销权以及优先购买权。
Collective constructive land into the market has entered the pilot phase, but collective and member rights allocation problem is not properly resolved. Considering this problem from the perspective of collective ownership and collective member rights considerations is much more appropriate. Specific interests should fol- low the principle of equitable balance of interests, autonomy of private law and social efficiency maximization under national control. In the institution building during collective constructive land into the market, the legisla- tion should protect the interests of collective interest distribution right and decision-making, revocation and first refusal rights of members.
