摘要
当前农村地权冲突的部分原因在于农民集体成员权制度缺乏科学的法理基础。为解决农民集体成员权争端,应将农民集体成员权制度建立在民事法的基础上。建立在民事法基础上的农民集体成员权将会对农村地权冲突的解决和集体经济组织的重建产生积极的影响。
At present, one of the reasons for rural land ownership contlict is the lack of science legal basis m farmers＇ collective member rights. To solve the conflicts, it should build farmers＇ collective member rights system on civil law. Then, the rights will solve rural land ownership conflicts and rebuild collective economic organizations in a possitive way.
