摘要
《条约法公约》第31条第3款(c)项引发了"有关国际法规则"的范围和时际疑问,在国际司法实践中,它们具体表现为对条约解释关联性变量和时间点变量的不同做法,关联性变量涉及自体解释与系统解释,而时间点变量则包含原始解释与演化解释。这些条约解释方法在实践中都得到了运用,其中系统解释和演化解释由于各有其适用的现实基础、原因或条件,所以日益成为当今条约解释的重要方法,而系统解释尤其会成为条约解释的一种趋势,但它们在实践适用都还存在一些疑问和不确定性,值得进一步关注和研究。这两种方法虽然整体上并行不悖,但通过《条约法公约》第31条第3款(c)项,它们紧密联系在一起。
Article 31 （3）（c） of the VCLT 1969 has invoked questions about the scope and timing of ＂relevant international rules,＂ which in international judicial practice embody the different practices in two variations, linkage and timing, of treaty interpretation. The linkage variation involves self - con- tained interpretation and systematic interpretation, and the timing variation includes original interpreta- tion and evolutive interpretation. All these interpretative techniques have been applied, of which system- atic interpretation and evolutive interpretation, thanks to their specific realistic foundation and causes or conditions, have been increasingly becoming important interpretative techniques of modern treaties, with systematic interpretation especially being a trend of treaty interpretation. There are still, however, some doubts and uncertainty regarding these two techniques, which are worthy of further concern and re- search. Generally these two techniques run in parallel, but they interact closely due to Article 31（3） （c） of the VCLT 1969.
