摘要
东道国为应对COVID-19采取的各类防控措施可能造成境内外国投资者的利益受损,随之产生各类国际投资争端。面临可能的国际投资仲裁风险,现有国际投资法律体系中的例外条款是东道国政府可以运用的抗辩事由。但是,国际投资协定中的公共健康例外条款、安全例外条款或是一般例外条款,在应对疫情索赔仲裁时都有不确定性。以新冠疫情为契机,东道国应该完善双边投资协定或者自由贸易协定中的例外条款,降低未来类似COVID-19大流行情境下为保护社会公共利益而采取规制措施的规制风险。
All kinds of prevention and control measures taken by the host country in response to COVID-19 may cause damage to the interests of foreign investors and cause kinds of international investment disputes.Facing the possible risk of international investment arbitration,the exception clause in the existing international investment legal system is the defense that the host country can use.However,the public health exception clause,the safety exception clause or the general exception clause in the international investment agreement are uncertain in dealing with the arbitration of claims.Taking COVID-19 as an opportunity,the host country should improve and perfect the exception clauses in bilateral investment agreements or free trade agreements,so as to reduce the risk of litigation in future similar COVID-19 pandemic situations and take regulatory measures to protect public interests.
