摘要
研究目的:深入分析城镇低效用地再开发面临的问题,总结地方实践创新经验,提出进一步推进城镇低效用地再开发的建议。研究方法:文献研究法和对比研究法。研究结果:中国城镇低效用地再开发面临资金短缺、产权复杂等现实困难,主要原因是规则的制约和缺失,对广东、浙江、辽宁3个省份集体建设用地管理、违法用地处理、出让方式改进等方面的创新进行了总结。研究结论:城镇低效用地再开发既是现实需要,又有一定的政策空间,应在全国层面完善集体建设用地管理、违法用地处理、土地出让和强制力运行等规则,按照科学规划、市场导向、利益共享的原则推进工作。
The purpose of this paper is to analyze the reuse problems of urban underused land, summarize the existent experiences in practices, and further propose policy recommendations for improving the reuse of underused urban land. Literature review and comparative study methods are employed. The paper firstly points out the practical difficulties in reusing the underused urban land, such as shortage of funds, complexity of property rights, and institutional constraints behind. Then the paper summarizes the practical policy innovations in Guangdong, Zhejiang, and Liaoning Province, including the construction land administration for rural collective owned land, the treatment of illegally used land, the changes of the mode of land use right transfer, etc. It is concluded that the underused urban land readjustment is practically needed and there are some aspects for policy amelioration in the current legal context. Therefore, the general rules for the amelioration should be established at national level, and some principles including scientific planning,marketization and sharing of interest should be concerned during the reuse of the underused construction land.
