摘要
建设用地在市场经济的推动下炊琼爇桂,而集体土地却古今一辙。宅基地改革以最终上升为相对完整的法律制度为要,并与《物权法》等统筹衔接。宅基地三权分置制度的政策尝试,试图平衡宅基地居住保障功能与财产功能,但三权之间存在的逻辑扞格与主体异质成为法律规制的理论与实践障碍。宅基地改革势在必行,因此,可借鉴土地承包经营权改革经验,建立集体内互换、转让,集体外出租的流转市场。
The construction land under the push of market economy cook has made great progresses,while the collective land remains unchanged.The main task of rural homestead reform is to transfer the policy to concrete legal regulations,and it should be coordinated with the property law.The homestead three-right separation policy makes an attempt to balance the function of residence guarantee and property, but the differences between the three rights become the theoretical and practical obstacle of legal regulation.However, the reform of homestead is imperative.Therefore, we can learn from the experience of land contract and management right reform to establish the intra-collective market for exchanging and transfer and off-collective market for rent.
