摘要
印尼雅万高铁是我国高铁全方位"走出去"的第一单,项目将采用中国技术、中国标准和中国装备,我国铁路企业应重点关注技术输出过程中的知识产权相关问题,在项目前期对目标国的潜在知识产权风险进行提前摸底。通过对印尼境内高铁专利现状进行全面检索与梳理,并结合项目实际,深入分析中国高铁技术输出印尼可能面临的知识产权风险,研究提出风险应对措施,为切实保护中国高铁核心技术、保障雅万高铁项目的顺利推进提供支撑。
Serving as the first project for Chinese high speed railway(HSR) to go global comprehensively, Indonesian Jakarta-Bandung HSR will adopt Chinese technologies, standards and equipment. Therefore, Chinese railway enterprises should pay close attention to intellectual property issues during technology export and make a pre-project investigation on the potential intellectual property risks of target country. Through retrieving and sorting the current situation of the HSR patents in Indonesia, as well as deeply analyzing the potential risks for China to export HSR technology to Indonesia, the paper puts forward risk handling measures, which provides supports for protecting Chinese HSR core technology and ensuring the smooth progress of Jakarta-Bandung HSR.
