摘要
违反注意义务的判定标准是过失侵权领域的重要理论,分析违反注意义务与过失的关系可以揭示注意义务对过失侵权认定的作用。考察域外侵权法违反注意义务判定标准,分析合理人标准和效益成本标准的优缺点及可借鉴程度,以期完善我国侵权法上违反注意义务的判定标准。
Criteria on breach of care is an important theory in the field of negligent tort, this paper analyses the relationship between breach of care and negligence to reveal the effect of duty of care in judging of negligent tort. By investigating the criteria on breach of care in the foreign tort law and analyzing the advantages and disad- vantages of reasonable people standard and benefit cost standard and its reference, this article aims at proposing reasonable points to improve criteria on breach of care in Chinese tort law.
