摘要
在关于侵权法哲学基础的研究中,经济分析与矫正正义是当下最主要的两条阐释路径,尤其是经济分析进路颇受人推崇。不过,经济分析进路存在理论上的诸多盲点与不足。相较而言,作为一种替代性方案,矫正正义能够弥补经济分析的理论疏漏。然而,主流的侵权法矫正正义诸学说存在将矫正正义形式化的趋势,尤其是将矫正正义视为道义论的一种派生性观念,从而忽视了矫正正义观念本身包含的规范性内容。在侵权法哲学领域探究矫正正义实质内容的出路也许在于从德性理论视角出发寻求洞识。
In the studies of the philosophical foundations of tort law,economic analysis and corrective justice are two most important paths of interpretation,and the approach of economic analysis has received considerable support.However,the approach of economic analysis still suffers from some theoretical blind spots and shortcomings.In contrast,corrective justice is an alternative that can compensate for the theoretical omissions of economic analysis.However,there is also a tendency for the mainstream doctrine of corrective justice in tort law to formalize corrective justice,especially as a derivative of deontology,thus neglecting the normative content of the concept of corrective justice itself.Seeking insight from the perspective of virtue theory may be the way out for exploring the substance of corrective justice in the field of tort theory.
