摘要
孔子的仁学思想折射了实践理性的基本特质,它构成了中华法系的理性基础,这使得中华法系表现出合规律性、合目的性和审美合理性的总体特征。孔子的中庸理念是中华法系思维方式的思想基础,中庸作为一种实践之知对混合法之法律样式、中华法系的道德化和情理化都产生了重要的影响,它有效地抵制了中华法系向绝对主义发展的可能性。正是由于孔子思想的实践理性和实践智慧的特质,才可能对孔子的思想进行实践法哲学的当代阐释,而这种阐释构成了理解中华法系的崭新视角。
Confucius' thought of benevolence reflects the feature of practical rationality,which constitutes the rational basis of the Chinese legal system, endowing the latter the features of conforming to regularity, teleology and esthetical rationality. Confucius' doctrine of the mean is the ideological basis of the Chinese legal system, which, as an outcome of practices, affects deeply the Chinese mixed -law pattern as well as the moralization and reasonable intention of the Chinese legal system, thereby effectively preventing its evolution to absolutism. Because of the practical rationality and wisdom in Confucian Thought, we can interpret it from the practical philosophy of law,and this is a totally new perspective on understanding the Chinese legal system.
