摘要
我国农民工最深层次的问题是生存权和发展权问题。农民工的生存权主要包括生命权、劳动权和社会保障权,农民工的发展权主要包括受教育权、参与权和公平分享发展成果权。在生存权和发展权视角下从实证角度对农民工的权利缺失进行了分析,提出了农民工权利保护的机制,如农民工权利的利益表达机制、社会救助机制、公平分享发展成果的法律机制、政府的行政保护机制和司法救济机制等。
The fundamental problem concerning peasant workers in China involves immediately their rights to existence and development. The former includes right to life, right to work, and right to social security, while the latter, right to receive education, right of participation and right to share the fruits of development. In the context of right to existence and development, this paper, with practical approaches, analyzes the absence of peasant- workers＇ right and proposes peasant - worker protection systems involving interest expression mechanism of peasant - workers＇ rights, social assistance system, legal mechanism to share the fruits of development, administrative protection system, and judicial relief system.
