摘要
竞业禁止制度作为市场经济中一种保护商业秘密和维护公平竞争的重要手段,其自身具有重要的价值功能;而每个公民都享有劳动的自由和择业的自由,这是宪法赋予公民的一项基本权利。因此,在我国竞业禁止制度完善过程中,应着力解决用人单位商业秘密权与劳动者择业自由权之间的矛盾和冲突,平衡二者的利益,以实现竞业禁止制度的价值目标。
System of non-competition is one of important means of protecting right of commercial secret and vindicating fair competition in the market economy, it has its important value. However, each citizen has the right of work and choosing profession, this is a basic right of constitution. So in the process of perfecting the system of non-competition in China, to achieve the value of non-competition, we should solve the conflict between the right of commercial secret and right of work and balance the behalf.
