摘要
复仇是对国家暴力垄断的蔑视,法律对此是予以禁止的。被官方奉为“大经大法”的儒家经典中支持和同情复仇的文字却又随处可见《。公羊》学对于复仇的态度较多地站在民间的立场上,强调其合理性。反对复仇理论的声音主要来自《春秋左传》学者和《周礼》学者。这些以《左传》和《周礼》为依据的古文经学家,迫于民间的力量和风俗,不敢悍然主张取消复仇,但对此设了限制,并主张官方干预。正是由于在经学上的取舍不同,才导致了汉代律令注释上纷繁复杂的局面。
The revenge was forbidden by law, but there were opinions in those officially advocated Confucian classics that supported and sympathized with revenge. It was because of the different opinions on Confucian classics that led to the complex situation of the annotation on decrees of Han Dynasty.
