摘要
增担保请求权是在抵押物价值减少的情况下,抵押权人所享有的保全抵押权的一种权利;增担保请求权只能通过诉讼外请求的方式行使,增担保的种类包括保证、抵押权、质权;增担保请求权与物上代位权发生竞合时,抵押权人得择一行使;在增担保请求权不能实现时,抵押权人得要求债务人提前清偿债务;我国应当在现有立法的基础上,进一步完善增担保请求权制度。
Claim of additional mortgage is the right that mortgagee enjoys to save his mortgage from damage when the value of guaranty cut down.The only approach to exercise this right is to claim it via non-lawsuit including the way of guarantee,mortgage and hypotheque.Mortgagee should choose one of the two rights to exercise when the claim of additional mortgage reencountered with the right of subrogation in another thing.When this right can’t be realized,mortgagee may claim debtor to fulfill his debt ahead of schedule.Our country’s legislation should consummate the rule of additional mortgage on the base of existed system.
