摘要
现有国际投资争议解决机制存在制度碎片、非协作化、矛盾集中、投资仲裁高成本等诸多缺陷,在价值理念、应用领域方面完全不能适应"一带一路"发展需求。重塑"一带一路"下国际投资争议解决机制,以协同治理理念化解投资争议"解而不决"的困境,是中国服务"一带一路"建设和致力于国际经贸规则再造涅槃的新思路。新机制应兼顾协同治理的三大理念提升、协同治理的三大制度重构、协同治理的三大机构创新,体现协作、互利、共通、共治特征,以满足"一带一路"沿线国家解决投资诉求的问题。中国应以发展中立视角积极推动国际投资争议协同治理新机制的构建,并在新机制的建设中发挥重要作用。
The existing international investment dispute settlement mechanism has many defects, such as institutional fragmentation, non-collaboration, high cost of investment arbitration, etc. And it is completely unable to adapt to development needs of "the Belt and Road". Reshaping the new mechanism of international investment dispute settlement under "the Belt and Road", and solving the dilemma of "decision without solution " in investment dispute with the concept of collaborative governance, is a new idea for China to service "the Belt and Road" construction and committing the nirvana of international economic and trade rule. The new mechanism takes into account the three points of improving concepts of collaborative governance, of institutional reconstitution of collaborative governance, and of organized innovation of collaborative governance. This mechanism reflects the synergistic, interactive, comprehensive, and systematic features, and hoping to meet the investment appeal of the countries along the Belt and Road. China should actively promote the construction of a new mechanism for collaborative governance international investment dispute from a developmentneutral perspective and should play an important role in the construction of new mechanisms.
