摘要
公平竞争审查标准是审查机构判断政策措施是否排除、限制市场竞争的准则,体现了国家在处理市场调节与政府干预、经济效率与经济公平、竞争政策与经济政策三对关系时的基本立场。我国现行的公平竞争审查标准体系由4项一级标准和18项二级标准构成,在审查实践中暴露出了审查标准因缺乏实质性和差异化审查标准而显得过于僵化、部分列举式审查标准具有较大的不确定性、审查标准与反垄断法和产业政策法等相关法律制度缺乏有效衔接的问题。有鉴于此,有必要从提炼公平竞争审查的实质性标准、针对重点领域和行业制定差异化审查标准、进一步完善列举式审查标准以及健全审查标准与相关制度有效衔接的机制四个方面着手对公平竞争审查标准进行规范再造。
The fair competition review standards serve as guidelines for regulatory agencies to assess whether policy measures exclude or restrict market competition.They embody the fundamental position of the state in managing the interplay between market regulation and government intervention,economic efficiency and economic fairness,and competition policy and economic policy.The current fair competition review standard system in China consists of four primary standards and eighteen secondary standards.However,in practice,several shortcomings have become apparent.These include the excessive rigidity of the review standards due to the lack of substantive and differentiated review standards,significant uncertainty associated with some enumerative standards,and the absence of effective alignment between the review standards and related legal frameworks such as antitrust law and industrial policy law.In light of these challenges,it is imperative to undertake a comprehensive reform of fair competition review standards.This would involve refining the substantive standards,formulating differentiated review standards tailored to specific sectors and industries,improving the enumerative review standards,and establishing mechanisms to ensure effective integration between review standards and relevant regulatory frameworks.
