摘要
高风险体育旅游项目因其自身特点,容易导致侵权责任事故的发生,并引发侵权责任纠纷,因此有必要对相关法律制度进行深入研究,以期形成完善的项目发展法律保障。通过运用规范分析法对相关法律制度进行分析和讨论,运用文献资料法,发现高风险体育旅游项目的侵权责任法律制度既具有一般侵权责任的共性,又因其自身特点而具有一定特殊性。同时也应当注意,高风险体育旅游项目侵权法律制度在立法、行政、司法和配套制度等方面还存在一些不足,进而会产生各种现实性的问题。因此,应当在结合高风险体育旅游项目自身特点和侵权责任法律制度基本原理的基础之上,从平衡保护旅游者合法权益;实现对被侵权人的救济和补偿;引导和规范相关产业健康发展以及化解社会矛盾之间相互关系等。综合运用立法、行政、司法等法律手段对相关法律制度予以完善,从而探索高风险体育旅游项目侵权责任法律问题的统一性、全局性、立体性和可操作性的解决方案。
High-risk sports tourism projects are liable to cause tort liability accidents and disputets because of their own characteristics.Therefore,it is necessary to conduct in-depth research on relevant legal systems in order to form a complete legal guarantee for project development.Through the normative analysis to analyze and discuss the related legal systems,using the method of literature,it is found that the legal system of tort liability for high-risk sports tourism projects has both the commonality of general tort liability,but also has certain particularity due to its own characteristics.At the same time,it should also be noted that there are still some deficiencies in legislation,administration,judicature and supporting system of high-risk sports tourism projects,which will lead to various practical problems.Therefore,on the basis of the characteristics of high-risk sports tourism projects and the basic principles of legal system of tort liability,we should integrate the legislation,administration,judicial and other legal means to perfect the relevant legal system from the perspective of the balance of protection of legitimate rights and interests of tourists;the relief and compensation of the infringed party;the guidance and specification of the healthy development of relative industry and the resolution of social conflicts,comprehensive use of legislation,administration,justice and other legal means to improve the relevant legal system,so as to explore a solution to the unity,overall situation,tridimensional and operability of legal issues on tort liability for high-risk sports tourism projects.
