摘要
"谈话"是监察法所确定的十二项法定调查措施之一,然而"谈话"作为一种制度,是对传统诉讼法以及行政监察法的超越,是监察法的一项全新创设。谈话制度贯通党内监督和国家监察,兼具监督、调查和处置三项功能。在监督阶段,把握监督执纪"四种形态"必须经常、大量运用谈话发现问题、纠正偏差、预防腐败,让"红脸出汗"成为常态;在调查阶段,谈话是问题线索初查核实的主要手段,在正式调查中可以有效配合其他调查措施提高调查的效率和效果;在处置阶段,四种谈话处置方式可以作为党纪处置独立适用,也可以附加适用,构建起宽严相济、软硬兼施的监察处置体系,实现纪法衔接、纪法协同。
"Talk"is one of the twelve statutory investigation measures determined by the Supervision Law.However,"talk"as a system is a transcendence of the traditional procedural law and the Administrative Supervision Law,which is a new creation of the Supervision Law.The talk system runs through intra-Party supervision and state supervision,and has three functions of supervision,investigation and disposal.In the supervision stage,grasping the"four forms"of supervision and discipline must frequently and extensively use the"talk"to find problems,correct deviations,prevent corruption,and make"red-faced sweating"a normal state.In the investigation stage,the"talk"is the main means for the initial investigation and verification of the problem clues.In the formal investigation,it can effectively cooperate with other investigation measures to improve the efficiency and effect of the investigation.In the disposal stage,four kinds of talk disposal methods can be used as independent or additional application of Party discipline disposal.It builds a supervision system of Combining Leniency with strictness and combining hardness with softness to realize the connection and coordination between discipline and law.
