摘要
中葡法文化于16世纪开始交汇于澳门,从法的精神和内容来看,两种法文化具有明显的异质性。面对法文明的潜在冲突,中葡双方在立法上相互包容和妥协,在司法上既遵循传统又有所变通,双方以惊人的包容力构建了历时数百年的澳门秩序。立法上,清政府充分尊重澳门的风俗习惯及自治权,葡萄牙虽形式上将本国法典延伸到澳门适用,但实践中出台了多项妥协性的法律和措施;司法上,清代地方政府处理涉葡案件虽沿用了传统的司法思维和方式,但在审理层级、审理程序、处理方法等方面又有所变通。中华法文明始终能以包容的精神对待异域文化,其解决法文明冲突的经验在人类法文明史上占有一席之地。
The legal culture of China and Portugal began to converge in Macao in the 16 th century,they have obvious heterogeneity from the perspective of the spirit and content of the law.In the face of conflicts,China and Portugal were mutually inclusive and compromised in legislation,and also followed the tradition and made some changes in the judiciary.In terms of legislation,they fully respected customs with each other.The local governments of the Qing Dynasty used traditional judicial methods to deal with Portuguese cases,but also had some changes.Chinese legal civilization was always able to treat foreign cultures in an inclusive manner.The experience of legal civilization conflicts has a place in the history of human law civilization.
