摘要
依规治党是一个制度实践先于理论发展的概念,这一概念随着全面从严治党的实践推进而成为理论研究的热点。关于依规治党的既有研究缺乏对党规、党内法规、党纪等关键概念的系统学理阐释,使其无法与制度治党、党内法规研究相区分,因而需要从规范维度重新梳理依规治党与相关概念的逻辑关系。依规治党具有独特的制度逻辑:马克思主义政党学说阐明了依规治党的意识形态特质;中国特色社会主义法治道路生成了依规治党的法治基因;国家治理体系与治理能力现代化折射出依规治党背后的政党中心主义逻辑。依规治党实践的不断深化需要完善依规治党的制度体系,不断提高党的执政能力和领导水平;从科学立规、严格执规、保障督规、自觉守规等方面推进依规治党的法治化建设;坚持依法治国与依规治党有机统一与统筹推进。
Rule-based governance over the Party is a concept that institutional practice precedes theoretical development.In recent years,it has become a hot topic in theoretical research with the advance of the practice of the full and rigorous governance over the Party.Existing researches lack systematic theoretical interpretation of key concepts such as Party rules,intraparty rules and regulations,and Party discipline,as a result of which the researches on rule-based governance over the Party are often indistinguishable from those on governing the Party institutionally and intraparty rules and regulations.Therefore,it is necessary to sort out the logical relationship of the rule-based governance over the Party and its related concepts from the perspective of normative system.Rule-based governance over the Party in the new era has its own institutional logic:Marxist party theory has illustrated the ideological nature of the rule-based governance over the Party in the new era;the socialist legal path with Chinese characteristics has given rise to the legalization gene of the rule-based governance over the Party in the new era;the modernization of the national governance system and capacity reflects the party centrism logic behind the rule-based governance over the Party.To deepen the practice of rule-based governance over the Party in the new era,the system of the rule-based governance over the Party shall be perfected and the Party’s governing capacity and leadership level shall be constantly improved.The construction of the legalization of the rule-based governance over the Party shall consider the following matters:scientific regulation,strict implementation of regulations,guarantee of supervising regulations,consciously abiding by the regulations.Lastly,the law-based governance of the country and the rule-based governance over the Party shall achieve organic unity and be simultaneously promoted.
