摘要
借用数学领域的交集概念,地方性法规与党内法规之间既具有直接交集,也具有间接交集,其中直接交集对应的是衔接问题的处理,间接交集对应的是协调问题的处理。地方性法规与党内法规产生衔接协调问题的原因与中央层面党规国法产生衔接协调问题的原因具有相似性,包括“党纪严于国法的政治要求”、党政分工的领导体制、党政联合发文机制与党组党委制度引发的党内法规溢出效力(效应)的影响,但地方性党内法规中的“自主性规定”与中央党内法规溢出效力(效应)在地方层面的独特性使得地方性法规与党内法规的衔接协调问题自有其特殊性,不完全是中央层面党规国法衔接协调问题的复刻,需要探索与之相关的衔接协调的基准。衔接协调的实现机制包括立法立规前建立人大机关和同级党委组织的沟通协商机制,立法立规中探索构建地方人大机关与党委组织共同参与地批准审查联动机制,立法立规后建立相应的评估机制及修改、废止的通报机制。
Borrowing from the concept of intersection in the field of mathematics,local laws and regulations and inner-party laws and regulations have both direct and indirect intersections.local laws and regulations inner-party laws and regulations.Among them,the direct intersection corresponds to the handling of the connection problem,which belongs to the static normative order;the indirect intersection corresponds to the handling of the coordination problem,which belongs to the dynamic normative order.The reasons for the connection and coordination of local laws and regulations and inner-party laws and regulations are similar to the reasons for the connection and coordination of inner-party laws and regulations and national laws at the central level,including the difference in value orientation of"party discipline is stricter than national law",the leadership system of the division of party and government,the influence of spillover effect of inner-party laws and regulations triggered by the party-government joint publishing mechanism and the party committee system.However,the uniqueness of the"autonomy regulations"and the spillover effects of inner-party laws and regulations at the local level makes the connection and coordination of local laws and regulations and party regulations have their own particularities,not entirely a repetition of the issue of connection and coordination of inner-party laws and regulations and national laws at the central level,and it is necessary to explore the benchmarks of connection and coordination related to it.The realization mechanism of connection and coordination includes the establishment of a communication and consultation mechanism between the people’s congress and the party committee organization at the same level before legislative legislation,and the establishment of a joint approval and review mechanism in which local people’s congress agencies and party committee organizations participate in the legislative legislation,and the establishment of corresponding assessment mechanism and notification mechanism for modification and abolition after legislative legislation.
