摘要
法学是一门研究国家制度和法律制度的理论之学,也是一门治国安邦、经世济民、服务社会的实践之学。70年来,新中国法学学科在理论创新、范式转换、体系变革中逐步走出了一条中国特色的学科发展之路,积累了丰硕的研究成果和宝贵的发展经验。新中国法学学科发展的基本规律,集中体现在扎根法治实践、推进学术创新、广泛吸收既有成果、外部交叉融合、内部分化细化、加强学术规划引导等6个方面。未来30年将是中华民族实现伟大复兴中国梦的关键时期,也将是中国法学实现跨越式大发展的黄金时期。法学学科主体性和原创性将显著增强,研究方法将进一步加快创新,与其他学科的双向互动将更加密切深入,未来法治研究将成为制高点,实践功能将进一步增强,国际话语权将大幅提升,最终形成对中国法治问题具有回应和解决能力、对世界法治议题具有设置和攻坚能力的科学化现代化的法学学科体系、学术体系和话语体系。
Legal science is not only a theoretical study of state institutions and legal system,but also apractical study of governing the country,benefiting the people and serving the society.In the past 70 years,legal science in New China has gradually embarked on a path of discipline development with Chinese characteristics in terms of theoretical innovation,paradigm transformation and system reform,and has accumulated rich research results and valuable development experience.The basic laws of development of legal science in New China are embodied in six aspects:taking root in legal practice,promoting academic innovation,widely absorbing existing achievements,external interactive integration,internal differentiation and specification,and strengthening academic planning and guidance.The next 30 years will be the key period for the Chinese nation to realize the Chinese Dream of great rejuvenation,and also the golden period for Chinese legal science to realize the great leap forward development.The subjectivity and originality of legal science will be significantly enhanced,its research methods will be further innovated,its two-way interaction with other disciplines will be more intensive,the future rule of law will become its commanding point,its practical functions will be further promoted,and its international discourse power will be greatly elevated.Finally,it will form more scientific and modern legal discipline system,academic system and discourse system with the ability to respond to and solve China’s legal issues,and set up and tackle the world’s legal issues.
