摘要
新制度主义源于经济学、政治学和社会学中的制度理论,以及心理学和人类学的相关研究。制度理论纷繁复杂,而斯科特试图使用一个综合性的理论框架整合早期的制度理论和新制度主义理论。斯科特划分了规制性、规范性和文化—认知性三大制度要素,并使用逻辑、能动性、载体及分析层次等范畴呈现新制度主义的分析方法与问题领域。斯科特的综合性理论给我们提供了新制度主义的理论地图,让我们更方便地参与新制度主义的对话。此外,在中国的法学研究中,新制度主义与法经济学展开了许多对话。但作为社会学重要理论的新制度主义却没能和中国的法社会学展开对话。从新制度主义对法律的关注、理论与实践的关系和理论自觉等方面来看,在法社会学内部推进新制度主义法学研究,大有可为的空间,而斯科特的综合性理论为此提供了一张理论蓝图。
New institutionalism comes from institutional theories in economics,politics and sociology,as well as related research in psychology and anthropology.Institutional theories are complicated,and W.Richard Scott tried to use a comprehensive theoretical framework to integrate the early institutional theories and the new institutionalism theories.Scott divided the three major institutional elements of regulatory,normative,and cultural-cognitiveness,and used logic,initiative,carrier,and analysis levels to present new institutionalist analysis methods and problem areas.Scott's comprehensive theory provides us with a theoretical map of new institutionalism,allowing us to more easily participate in the dialogue of new institutionalism.In addition,new institutionalism has opened many dialogues with law and economics in China.However,as an important theory of sociology,the new institutionalism failed to initi-ate a dialogue with sociology of law in China.From the perspectives of new institutionalism's attention to law,the relationship between theory and practice,and theoretical consciousness,there is a lot of room for advancing new institutional legal research within sociology of law,and Scott's comprehensive theory provides a theoretical blueprint for us.
