摘要
执法案卷制作是一个将行政执法中的原始事实转化为文本事实的动态过程。制卷者通过专业分工对原始事实进行程式化排序和结构化记录,提高了行政组织获取信息和实施监管的能力。执法案卷制作是赋予执法机构清晰的组织目标、标准化的治理程序,以增强行政组织理性能力、提升治理效能的技术治理过程,呈现出三种实践逻辑:加强科层结构"条条"控制,深化渐进式改革,形成技术自我强化。执法案卷制作的技术治理在组织和制度制约、主观意志植入、过度简化等因素影响下,衍生出重构执法目标、形成不均衡赋权、制造反控制空间等预期外效应。反思行政执法的技术治理逻辑及其限度,要义在于回归治理的公共属性与人文关怀,推动价值治理与技术治理同频共振,从公民内心认同出发,强化执法的合法性和有效性。
The production of administrative files is a dynamic process that converts primitive facts into constructed facts.The bureaucracy has carried out a standardized and structured record of primitive facts through specialized division of labor,which has improved its rational ability to obtain information and remote supervision,thereby promoting a more standardized law enforcement.This fact reflects the technical governance logic of files making,which enhances the rationality of the bureaucracy through technological optimization and the efficiency of national governance through bureaucratic development.Projecting this logic to the reform of national governance modernization,it can be found that the latter has three distinctive features:strengthening vertical management in the established bureaucratic structure,reducing potential transformation risks by gradual reform,and attaching importance to the application of technology.On the other hand,organizational and institutional constraints,power implantation,and excessive simplification of the interaction between subjects set the limits of files production,deriving some unexpected results such as reshaping the goals of law enforcement,forming uneven empowerment,and creating anti-control space.The purpose of introspecting the limits of technical governance is to adhere to the guidance of value to technology,to promote the simultaneous development of value and technology and to realize the inner recognition to administrative law enforcement.
