摘要 父母与子女之间的血缘关系和父母对家庭“反哺”功能的追求是其家庭教育权利的自然渊源,而各国宪法和国际法对家庭教育权利的规定则是父母家庭教育权利的法律渊源。与亲权内涵的演变相伴的是绝对父权的弱化与儿童权利的强化。儿童最大利益原则是父母家庭教育权利内容确认的前提。父母家庭教育权利的具体内容包括教育内容选择权、教育方式选择权、学校选择权、学校教育参与权和诉权。父母家庭教育权利的实现有赖于相关主体的尊重及给付义务的履行。其中,相关主体给付义务主要包括政府促进父母家庭教育权利实现的给付义务、社会支持家庭教育服务体系建设的给付义务、学校指导父母家庭教育素养培育的给付义务、父母提供物质能力和责任能力及行为能力的给付义务。 The natural source of parents'right to family education is the blood relationship between parents and children and the pursuit of the“refeeding”functions;the legal source of parents'right to family education is the provisions of national constitutions and international Law.The evolution of the connotation of“parental rights”implies two lines of development of rights:the weakening of absolute paternal authority and the promotion of the rights of the child.The principle of the best interests of children is a prerequisite for the recognition of the content of parents'right to family education;the specific content of parents'right to family education includes the right to choose the content of education,the right to choose the mode of education,the right to choose school,the right to participate in school education and the right to appeal.The fulfilment of parents'right to family education depends on the fulfilment of the payment obligations of the relevant subjects,including the obligation of the government to promote the realisation of parents'right to family education,the obligation of society to support the establishment of family education service system,the obligation of schools to guide parents in the cultivation of family education literacy and the obligation of parents to provide material capacity,responsibility and behavioural capacity.
