摘要
党的二十大报告多次提到推动构建人类命运共同体,指出其是中国式现代化的重要组成部分。近年来,随着这一与国际法有密切联系的概念的主流化,其深入推广进程在理论和实践上遇到了一定国际阻力。国际政治与法律界对该概念的争论虽聚焦在不同的具体问题上,但从根本上看,理解争议的关键在于外界对中国“天下”观念的负面认识。对此,有必要进一步阐释人类命运共同体概念所面对的复杂的国际法体系和历史,基于对以“威斯特伐利亚”和“天下”为代表的“过去”的剖析,才能更好地理解人类命运共同体构建的“现在”和“未来”,推动进一步的沟通和建设。人类命运共同体概念的规范价值,正在于对国际法规则体系过去的扬弃,现在的呼应,以及未来愿景的展望。这一规范性构建仍处于初步阶段,需要在微观规则、中观体系和宏观共识层面进行推进。
The Report of the 20th National Congress of the Communist Party of China repeatedly mentions the building of a human community with a shared future,claiming it as an important part of Chinese-style modernization.As this increasingly popular concept is closely related to international law,its promotion in recent years has encountered certain international resistance in theory and practice.Although the debates on this concept in the international political and legal arenas have focused on different specific issues,the core issue lies in the negative perception of the Chinese notion of tianxia(“the world under heaven”).It is therefore necessary to further explain the complex international legal system and its history that faces the concept of a human community with a shared future.Only by analyzing the“past”represented by“Westphalia”and tianxia can we better understand the“present”and“future”created by a human community with a shared future and promote further propagation and construction of the concept.The normative value of the concept of a human community with a shared future lies in the sublation of the past,the response to the present,and the vision for the future of the international legal system.This process of construction is still in the early stage and needs to be advanced at the micro(rules),meso(systems)and macro(consensus)levels.
