摘要
法官会议的实践运行已有多年,但仍存在不少问题,突出表现在法学理论深度不够、案件研讨效益不高、与审委会的实践定位交叉杂糅、涉密性与开放性的矛盾未得缓释四个方面,亟待改革完善。2020年6月江苏高院出台的《专业法官会议工作规则》设立了成文规范,但存在进一步完善的空间,尤其呼唤智能手段的支持和助力,传统运行机制亟待进行智慧化改良。随着大数据、移动网络、人工智能等现代科技的发展和应用,智慧法官会议可以从以下三方面予以构建:第一,引入专家系统,将法官会议运行机制交由机器实施;第二,构建智能会议系统,开启法官会议“电网”模式;第三,完善类案推送系统,为法官会议配置“大数据”引擎。在法官会议的智慧化改良问题上,法律人一方面应保持开放心态积极迎接智慧法院大势,另一方面要切实在利用智能工具提升法官会议运行效率和研判效益上下功夫,既要摒除技术崇拜也无需在被人工智能取代的问题上杞人忧天。
The judges conference has been operated for years.Many problems still exist,with outstanding performance in four aspects:insufficient theoretical depth,low discussion benefit,confusion with judicial committee system,contradiction between confidentiality and openness.“Working Rules for Professional Judges Conference”in Jiangsu issues in June 2020,providing written rules.However,there’s still room for improvement especially on intelligent design while the traditional system needs improvement eagerly.On the basis of big data,mobile network and artificial intelligence,wisdom judges conference can be established in three ways:Firstly,bring in Expert Systems,delivering the judges conference to machines.Secondly,build the intelligent conference system,starting“electronic and network modes”.Thirdly,consummate classified legal cases push system,equipping the judges conference with“big data”engine.For the improvement of wisdom judges conference,the legal person should keep an open mind to meet intelligent justice.Meanwhile,we should focus on improving efficiency of the judges conference with the help of smart means.Worship of technology should be eliminated,while being replaced by AI is alarmist.
