摘要
人工智能革命在带来社会快速进步的同时加剧了不平等,其原因在于不同主体对于"知识"这一人工智能驱动核心掌握程度的差异。因而在人工智能时代,受教育权的自身价值与保障公民其他权利的工具性价值上升,其内涵也得到扩张。在这种情形下,国家义务的核心是提升公民的数字素养、消除功能性文盲,以使公民实现人格的全面发展、适应新的社会环境并充分行使各项权利。而这种义务既包括给付义务又包括保障义务,既有即刻的义务又有渐进的义务。其中,国家通过专门的行政手段快速弥合人工智能正在造成的鸿沟尤为重要。
The artificial intelligence revolution has brought about the rapid progress of the society and aggravated the inequality,which is due to the difference in the degree of mastering the core of the artificial intelligence driven by the different subjects.Therefore,in the era of AI,the value of the right to education and the instrumental value of protecting other rights of citizens have increased.In this case,the core of the state’s obligations is to improve citizens’digital literacy and eliminate functional illiteracy,so as to enable citizens to realize the overall development of their personality,adapt to the new social environment and fully exercise their rights.This obligation includes both the obligation to pay and the obligation to protect,both the immediate obligations and gradual obligations.Among them,it is particularly important for the state to quickly bridge the gap created by artificial intelligence through special administrative means.
