摘要
多元主体维护平台生态就构成了平台治理,平台治理的内容在平台层面体现为平台规则,平台规则是平台履责的重要方式。实务界和理论界对于平台规则是什么没有定论,基本有算法说、策略说和机制说,但是均无法准确描述平台规则的内涵和属性。界面本来是计算机领域的术语,是不同组件的交互和共享的边界,被越来越多地应用到其他领域。平台规则串联起了平台、用户和其他利益相关者,可以承担对他们整合、转译、互释和呈现的功能,是他们进行交互的"界面"。以界面来理解平台规则,可以缓解其不确定性,增强其强制效力,也可以固化其交互性、强化其多元性,优化其及时性,使平台规则可以更好地起到平台和用户的交互作用,补充平台经济时代法律规制性的不足,更好地开展平台治理。
The maintenance of platform ecology by multiple subjects constitutes platform governance. The content of platform governance is reflected as platform rules at the platform. Platform rules are an important way for platforms to fulfill their responsibilities. There are no conclusion on what the platform rules are in the practical and theoretical circles. There are basically algorithm theory,strategy theory and mechanism theory,but none of them can accurately describe the connotation and nature of the platform rules. Interface is a term originally used in the computer science,as the boundary between the interaction and sharing of different components,and is increasingly applied to other fields. Platform rules connect the platform,users and other stakeholders. It can assume the functions of integration,translation,mutual interpretation and presentation for them, which is the " interface " for their interaction. Understanding the rules of the platform through the interface can alleviate its uncertainty and enhance its enforcement effect. It also can solidify interactivity of platform rules,strengthen its diversity,optimize its timeliness,make the platform rules play a better role of the interaction beteen platform and user. This kind of understanding can supplement the deficiency of legal regulation in platform economy era and better carry out platform governance.
