摘要
算法价格歧视的产生缘于商人经营活动的趋利性、行为实施成本较低以及用户对平台的依赖性。随着互联网技术的不断发展,算法价格歧视表现出隐蔽性更高、用户锁定更为准确以及侵犯消费者隐私的问题更为严重等特征。算法价格歧视的反垄断规制存在市场支配地位认定不易、执法活动开展困难以及尚未形成完备监督体系的现实困境。为此,应完善大数据平台市场支配地位认定方法,全面提高反垄断执法的能力,健全算法价格歧视的监督管理体系,从而更好地实现算法价格歧视的反垄断规制。
The emergence of algorithmic price discrimination is due to the profit orientation of business activities,low cost of behavior implementation,and user dependence on the platform.With the continuous development of internet technology,it has shown higher concealment,more accurate user locking,and more worrying trend characteristics for consumer privacy.Currently,there are practical difficulties in determining market dominance,implementing law enforcement activities,and not yet forming a complete supervision system.Therefore,it should improve the identification method of Big data platform’s dominant position in the market,comprehensively improve the ability of anti-monopoly law enforcement,and improve the supervision and management system of algorithmic price discrimination to respond to the anti-monopoly regulation demand of algorithmic price discrimination.
