摘要
司法裁决具有构成性,一项裁决是在法律、理性和态度等因素共同影响下形成的。这些因素的影响力以"影响度"的形式呈现出来。在"议会主权""司法主义"和"本位主义"这三种不同的制度中,法律、理性和态度因素对裁决有着不同的"影响度"。分析司法裁决构成因素的"影响度",对正确认识司法裁决的影响因素及其相互关系,强化态度因素的反制力量,维护裁决的正义价值,保障法院独立地位,推进司法制度改革具有重要的理论和实践意义。
The Judicial decision is a constitutive category.A decision is formed by the influence of law,reason and attitude,which is presented as"influence degree".In the three different systems of"Parliamentary Sovereignty","Judicial Doctrine"and"Departmentalism",the law,reason and attitude play different"influence degree"on the decision.The analysis of"influence degree"of different factors in judicial adjudication is helpful to correctly understand the constitutive elements and their mutual relations.It is of great theoretical and practical significance to analyze the"influence degree"of the constitutive factors of judicial adjudication for correctly understanding the influencing factors of judicial adjudication and their mutual relations,strengthening the counter force of attitude factors,maintaining the justice value of adjudication,ensuring the independent status of court,and promoting the reform of judicial system.
