摘要
在以审判为中心的刑事诉讼制度改革中,应当破除审判中心等同于法院中心之禁锢,避免过度强调庭审实质化而落入程序形式主义之圈套,而应将审判程序植入整个刑事诉讼过程并强调审判职能的中心地位。在审判中心视角下,法院应当树立独立审判、保障人权之角色期待,确保法院审判不受其他主体干预,并将程序公正置于优先位置,以保障被告人合法权利作为第一要义。基于此,法院应当保证刑事诉讼各阶段不同权力与资源配置的合理性,通过规范庭前准备程序、普通审理程序、证据认定规则、繁简分流制度以推进庭审实质化,加强法官队伍及辅助人员建设,强调权责划分的明确性。
In the reform of the criminal procedure system centered on trial,we have to realize that the trial center is not the court center,and the excessive emphasis on the substantiveness of court trials will lead to procedural formalism.The trial procedure is embedded in the entire criminal procedure,and it should be emphasized that trial function is the center.From the perspective of the trial center,the court should establish the expectation on independent trial and protection of human rights.We have to ensure that court trials are not interfered by other subjects and guarantee the procedural justice to protect the legal rights of the defendant.Based on this,the court should ensure the rationality of the allocation of different powers and resources at various stages of criminal proceedings.In order to Promote the substantiveness of the court trial,the following actions can be taken,such as standardizing the pretrial preparation procedures,ordinary trial procedures,evidence determination rules,and the system of diversion of complex and simplified procedures.Finally,it’s necessary to strengthen the construction of judges and supporting staff,and emphasize the clarity of the division of powers and responsibilities.
