摘要
企业数据刑事合规是企业刑事合规体系的重要组成部分,与一般刑事合规内容相比,企业数据刑事合规以数据为核心要素。企业数据刑事合规可以降低企业经营刑事法律风险,同时可有效避免针对企业数据的犯罪行为。根据数据刑事法律风险的不同表现形式,可将数据刑事法律风险归结为数据垄断风险、数据获取风险与数据泄露风险;在企业经营中,根据数据刑事风险的具体内容,应构建一个事前、事中及事后的数据刑事合规防控体系。
Enterprise data criminal compliance is an important part of enterprise criminal compliance system.Compared with general criminal compliance content,enterprise data criminal compliance takes data as the core element.Enterprise data criminal compliance can reduce the legal risk of enterprise operation and effectively avoid the criminal behavior against enterprise data.According to the different forms of the data criminal legal risk,the data criminal legal risk can be classified into data monopoly risk,data acquisition risk and data leakage risk.According to the specific content of data criminal risk,a data criminal compliance prevention and control system covering all fields of enterprise operation before,during and after the event should be constructed.
