摘要
我国对于统一行政法典的探讨,已经经历了"行政基本法"和"统一行政程序法"两个阶段,现在学界又提出"先制定行政法总则,后编纂行政法分则"的思路。行政法典只能是关于一般行政法的法典,其内容也主要应是程序性的,包括行政组织设置程序、行政行为程序、行政执行程序和行政救济程序四部分。即便如此,其编纂也面临复杂而艰巨的任务。实践证明,民法典选择的"单行法先行"路径是成功的,行政立法应借鉴民法典的编纂模式,逐步推进。将来,应当按照"类行为程序法先行模式"继续推进统一行政程序法的制定,在协调党内法规和行政法规的基础上推进统一行政组织法——特别是行政机构编制法的制定。这些重点和难点问题解决了,制定行政法总则进而编纂行政法典的条件也就成熟了。
The research on the administrative code in our country has gone through two stages:"administrative basic act"and"unified administrative procedure act".Now the academic circle puts forward a new idea of"making the general provisions of the administrative law first,and then compiling the specific provisions of the administrative law",which is worth studying.The administrative code can only be the code of general administrative law,but also mainly procedural code,including administrative organization law,administrative procedure law,administrative enforcement law and administrative relief law.Even so,its codification faces a complex and daunting task.Practice has proved that the path of"step by step"chosen by the Civil Code is successful,and the administrative legislation should draw lessons from this compilation mode and push forward step by step.In the future,we should continue to promote the formulation of the Administrative Procedure Act and the Administrative Organization Act.Once these key and difficult problems have been solved,conditions will be ripe for the formulation of the general provisions of the administrative law and the compilation of the administrative code.
