摘要
隐含技术特征是指未以文字形式明确记载在权利要求书中,但所属领域普通技术人员通过阅读专利文件后能够直接地、毫无疑义地确定的技术特征,是根据说明书或者附图对权利要求书围绕发明目的进行解释的结果,具有必然性、具体性、唯一性。隐含技术特征是专利授权、确权行政程序和现有技术抗辩诉讼程序中的概念,对于专利权的保护范围具有限定作用,它与必要技术特征、功能性技术特征、公众常识相伴相生,但在法律概念,上又存在区别。因此为全面、准确地解释权利要求的保护范围,在专利侵权民事诉讼程序中存在揭示隐含技术特征的客观性与必要性。
Implied technical features refer to technical features that are not explicitly recorded in written form,and they can be determined by a person of ordinary skill in the field directly and undoubtedly after reading the patent documents.Implied technical features are the results of explaining the content of the claim around the purpose of the invention according to the specification or the attached drawings,which are necessary、specific and unique.Implied technical features are concepts in patent authorization procedure,patent verification procedures,and litigation procedure of prior art defense.Implied technic al features have a restrictive effect on the scope of patent protection.Implied technical features are accompanied by necessary technical features、functional technical features and common knowledge,but there are obvious differences in legal concepts.Therefore,in order to fully and accurately interpret the scope of protection of the claims,it is necessary and objective to reveal the implied technical features.
