摘要
通过对157例样本进行分析可知,在司法实践中,运用案例主张观点的方法被重视程度逐步提升、“真”刑事指导性案例的低援引率与公众对案例援引的旺盛需求反差明显,但无论从援引积极性、援引对象等方面均可以看出整体援引质量在逐步提高。目前刑事指导性案例在裁判援引方面依然存在说理性不足、援引用语与表述形式不规范等问题,有待通过援引适用判断方法的明确以及多管齐下保障机制的建构等方面予以规范。
Through the analysis of 157 samples,it can be seen that in judicial practice,the method of applying the viewpoint of guiding cases has been paid more and more attention and the contrast between the low citation rate of“true”criminal guiding cases and the strong demand of the public for case citation is obvious,but the overall citation quality can be seen to be gradually improved from the aspects of citing enthusiasm and objects.At present,there are still some problems in judicial citation of criminal guiding cases,such as the lack of reasoning,the nonstandard in quotation and expression,etc.,which need to be regulated by making the clear judgment method in citation and application and the construction of multi-channel safeguard mechanism.
