粤港澳大湾区数据跨境流动的治理反思与模式重塑被引量：2

Governance Reflection and Model Reshaping of Cross-border Data Flow in the Guangdong-Hong Kong-Macao Greater Bay Area

摘要粤港澳大湾区数据跨境流动需求日益增长,但三地数据治理规则衔接滞后,导致数据跨境流动面临诸多障碍。为解决这一问题,大湾区逐渐形成了“协商型”数据治理模式,旨在建立统一的数据治理规则和标准。随着粤港澳大湾区数据产业的蓬勃发展,该模式已经难以适应快速变化的数据环境,有必要从以下四个维度进一步探索粤港澳大湾区数据跨境流动协同治理的新模式:顶层设计、治理架构、底线安全和纠纷解决。顶层设计层面应由中央进行整体立法,构建大湾区数据法治结构;治理架构层面应完善数据跨境流动制度架构,明确数据权属和定价标准;底线安全层面应建立数据出境风险评估制度、数据分级分类监管制度以及探索跨境安全流动的黑白名单规则;纠纷解决层面应推动形成共建共治共享的数据纠纷解决机制。 The demand for cross-border data fow in the Greater Bay Area is increasing,but the convergence of data governance rules among the three regions is lagging behind,which leads to many obstacles in cross-border data fow.To solve this problem,the Greater Bay Area has gradually formed a"consultative"data governance model,aiming to establish unified data governance rules and standards.With the vigorous development of the Greater Bay Area's data industry,this model has been diffcult to adapt to the rapidly changing data environment.It is necessary to further explore the new model of collaborative governance of the Greater Bay Area data cross-border fows from the following four dimensions:top-level design,governance structure,bottom-line security and dispute resolution.Specifcally,the top-level design level shall be legislated by the central government to build a data rule of law structure in the Greater Bay Area;the governance structure level shall improve the institutional framework for cross-border data flow and clarify data ownership and pricing standards;the bottom-line security level shall establish a data exit risk assessment system,a data classifcation and supervision system,and explore black and white list rules for cross-border safe fow;the dispute resolution level shall promote the formation of a data dispute resolution mechanism for joint construction,joint governance,and shared benefts.
