摘要
《大宪章》是英国宪法史和法律史的核心文件,不同时期的研究者对其进行了各种阐释。随着宪法史和法律史研究的推进,《大宪章》的整体性解释仍待形成。近来,约翰·贝克写作了《重新发明〈大宪章〉》一书,探究了英格兰的法律人如何、何时以及为何,开始思考个人自由、宪政王权、法治与《大宪章》之间的联系。该书至少有四大突破,即对律师会馆讲稿的搜集,对《大宪章》中世纪理解的梳理,对援引1225年《大宪章》第29章的案例报告的解读以及重估柯克对《大宪章》的解释。该书是法律史视域下最为权威的《大宪章》研究,不过,书中诸多细节及观点仍有可深入讨论之处。
Magna Carta is the core document of English constitutional and legal history and researchers of different periods have made various interpretations to it.With the development of constitutional and legal history,the overall interpretation of Magna Carta is still to be formed.Recently,John Baker wrote the Reinvention of Magna Carta,which explores how,when and why the English lawyers began to think about the connection between individual liberty,constitutional monarchy,the rule of law and Magna Carta.There are at least four new discoveries:the collection of lectures,the medieval understanding of Magna Carta,the interpretation of case reports citing chapter 29 of 1225,and the reassessment of Coke’s interpretation of Magna Carta.The book is the most authoritative study of Magna Carta from the perspective of legal history,but there are plenty of details and ideas to be discussed.
